- Eligibility: The Unwrap the Wonder Giveaway (the “Giveaway”) is open only to legal residents of the United States who are at least eighteen (18) years old at the time of participation. Employees of Kendra Scott, LLC (“Sponsor”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to participate.
- Promotion Period: The Giveaway is available during the store hours at each Kendra Scott and Yellow Rose by Kendra Scott retail location on December 21, 2024 or while prizes last, if earlier (the “Promotion Period”). Find retail locations and store hours here.
- How to Participate: The first five (5) eligible participants to arrive (as determined by Sponsor, in its sole discretion) at any Kendra Scott or Yellow Rose by Kendra Scott retail location during the Promotion Period will receive a prize. Participants who arrive before the Kendra Scott or Yellow Rose by Kendra Scott retail location opens for business on December 21, 2024 will be asked to line up in the order in which each person arrived. There is a limit of one (1) prize per household. Any participant who attempts to participate multiple times is in violation of these Terms & Conditions. Participants further agree to not prevent others from participating in or engaging with the Giveaway. By participating, you indicate your full agreement to these Terms & Conditions and Sponsor’s decisions regarding the Giveaway, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Terms & Conditions.
- Potential Winner Requirements: A winner may be required to submit a W-9 for tax purposes, sign a declaration of eligibility, and a liability/publicity release. If a winner is unwilling to sign and return these documents, they may be disqualified from the Giveaway and the prize will be awarded to the next eligible participant.
- Prize: Seven Hundred and Twenty (720) winners will receive a Kendra Scott Gift Card valued at $25. Ten (10) winners will receive a Kendra Scott Gift Card valued at $100. All prizes will be valid for use at any Kendra Scott or Yellow Rose by Kendra Scott retail location. The winner is responsible for paying any applicable income taxes and any and all other costs listed above. Any prize details not specified above will be determined by Sponsor in its sole discretion. The prize may not be transferred prior to award. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason. The total approximate retail value (“ARV”) of all prizes combined is $19,000. LIMIT ONE (1) PRIZE PER HOUSEHOLD.
- General Conditions: In the event that the operation of the Giveaway is impaired in any way, Sponsor may, in its sole discretion, either (a) modify the giveaway to address the impairment or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Giveaway, violates these Official Rules, or acts in a disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Giveaway. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that term. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. The Giveaway is subject to federal, state, and local laws and regulations and is void where prohibited.
- Release and Limitations of Liability: By entering, you agree to release and hold harmless Sponsor, its parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Giveaway; or (f) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- Privacy: Any information you submit as part of the Giveaway will be treated in accordance with Sponsor’s Privacy Policy. Except where prohibited, participation in the Giveaway constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
- Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules (whether of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Texas.
- Winner Information: To request a winners list, send a self-addressed, stamped envelope to Kendra Scott, LLC, Attn: Unwrap The Wonder Giveaway, 3800 N Lamar Blvd, Suite 400, Austin, Texas 78756. Requests must be received within thirty (30) days of the end of the Promotion Period.
- Sponsor: The Giveaway is sponsored by Kendra Scott, LLC. Sponsor is located at 3800 N Lamar Blvd, Suite 400, Austin, Texas 78756. Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram, Twitter, Facebook, Pinterest and/or any other social media website or platform on which it may appear.
