Official Rules for the Dear Kendra Scott Contest

No purchase is required to enter.

1. Eligibility:  The Contest is open only to legal residents of the United States who are at least eighteen (18) years old at the time of entry. Employees of Kendra Scott, LLC (“Sponsor”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.
2. Entry Period:  The Entry Period begins at approximately 10 AM CT on January 8, 2025 and ends at 11:59 PM CT on January 29, 2025 (the “Entry Period”). Sponsor’s computer is the official time-keeping device for the Contest.
3. How to Enter:  Follow one of the entry methods outlined below during the Entry Period to enter the Contest.

Method 1: Enter by mail

Send an original written letter to Attn: Dear Kendra Scott Contest, 3800 N Lamar Blvd, Suite 400, Austin, Texas 78756, and share how Kendra Scott is part of your love story with your partner, family, or friend. Your letter must include your e-mail address and/or Instagram handle.

Mail-in entries must include all required information (as provided above) to be considered a valid entry and must be postmarked during the Entry Period and received by Sponsor no later than two (2) days after the end of the Entry Period. Requests for confirmation of receipt of mail-in entries will not be acknowledged. Sponsor is not responsible for late, lost, damaged, stolen, incomplete, illegible, postage due, or misdirected entries. Proof of mailing does not constitute proof of delivery.

Method 2: Enter by social post

Post on Instagram using the hashtag #DearKendraScott and share in the caption how Kendra Scott is part of your love story with your partner, family, or friend. Your Instagram profile must be public in order for your post to be considered an entry into the Contest.

There is a limit of one (1) entry per person. Method of entry does not affect a participant’s ability to win a prize. By entering, you indicate your full agreement to these Official Rules and Sponsor’s decisions regarding the Contest, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.

4. Winner Selection:  On or about February 1, 2025, Sponsor will select three (3) potential winners based on the following criteria, in the sole discretion of Sponsor:

1. Originality
2. Adherence to the theme of the Contest
3. Emotional connection

Sponsor will attempt to contact the potential winner within five (5) business days of the drawing by e-mail or direct message on Instagram, using the contact information provided in their entry.

5. Potential Winner Requirements:  A potential winner may be required to submit a W-9 for tax purposes, sign a declaration of eligibility, liability/publicity release. If a potential winner fails to sign and return these documents within 2 business days, an alternate potential winner may be selected in his/her place in a random drawing of all remaining entries received. Only three (3) alternate potential winners may be contacted.
6. Content Requirements: Your entry must not (a) violate any third party rights, including, but not limited to, copyrights, trademark rights, or rights of privacy and publicity; (b) contain defamatory statements; (c) include threats to any person, place, business, or group; (d) be obscene or indecent; (e) depict any risky behavior, as determined by Sponsor in its sole discretion; (f) contain any third party trademarks or logos, other than the Kendra Scott trademark or logo; or (g) have been entered in any other contest or have been published or distributed in any other media. Sponsor reserves the right to refuse to post any entry for any reason.
    
7. Prize:  Three (3) winners will receive a two thousand dollar (USD $2,000) Kendra Scott gift card. The winner is responsible for paying any applicable income taxes and any and all other costs listed above. Any prize details not specified above will be determined by Sponsor in its sole discretion. The prize may not be transferred prior to award. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason. The total approximate retail value (“ARV”) of all prizes combined is $6,000.
8. General Conditions:  In the event that the operation of the Contest is impaired in any way, Sponsor may, in its sole discretion, either (a) modify the Contest to address the impairment or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Contest, violates these Official Rules, or acts in a disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Contest. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that term. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. The Contest is subject to federal, state, and local laws and regulations and is void where prohibited.
9. Entrant’s Warranties and Representations:  By submitting an entry, you warrant and represent that (a) the entry is an original work created solely by you for entry in the Contest; (b) you own all rights to the entry; (c) to the extent the entry depicts or features the voice of any individual, you are the individual pictured and heard in the submission, or, alternatively, that you have obtained written permission from each person appearing in the entry to grant the rights to Sponsor described in the “Sponsor’s Rights to Entries” section below, and can make written copies of such permissions available to Sponsor upon request; and (d) the entry complies with all requirements of these Official Rules.
10. Release and Limitations of Liability:  By entering, you agree to release and hold harmless Sponsor, Instagram, Twitter, Facebook, Pinterest and/or any other social media website, and each of their parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
11. Privacy:  Any information you submit as part of the Contest will be treated in accordance with Sponsor’s Privacy Policy.  Except where prohibited, participation in the Contest constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
12. Disputes:  Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules (whether of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Texas.
13. Winner Information:  To request a winners list, send a self-addressed, stamped envelope to Kendra Scott, LLC, Attn: Dear Kendra Scott Contest, 3800 N Lamar Blvd, Suite 400, Austin, Texas 78756.  Requests must be received within thirty (30) days of the end of the Entry Period.
14. Sponsor:  The Contest is sponsored by Kendra Scott, LLC. Sponsor is located at 3800 N Lamar Blvd, Suite 400, Austin, Texas 78756. Contest is in no way sponsored, endorsed, administered by, or associated with Instagram, Twitter, Facebook, Pinterest and/or any other social media website or platform on which it may appear.
